Terms of Service — Got Your 6

Effective date: November 7, 2026

Summary (plain-English, not a substitute for the full terms) - What this is. Got Your 6 is a personal-safety app that can alert the emergency contacts you choose — via an SOS button, live "Track me" sharing, a dead-man's-switch inactivity check, a mutual watch circle, and optional voice-activated SOS. - NOT an emergency service. Got Your 6 is not a substitute for 911 or professional emergency services and cannot guarantee that any alert will be delivered. In an emergency, call your local emergency number. See Section 3. - Your contacts, your responsibility. You must enter accurate contact details and only add people who have agreed to be your contact. Emergency contacts must separately opt in before receiving SMS alerts and may reply STOP to stop Got Your 6 SMS. - No false alarms. Don't misuse SOS or send false alerts. - Technology can fail. Software defects, device or network failures, maintenance, cyber incidents, third-party-provider outages, and events beyond reasonable control may interrupt the Service. Monitoring and incident-response tools reduce risk but do not guarantee detection, notice, recovery, or uninterrupted operation. - Automatic check-ins are best-effort. Free users must check in manually. Guardian Plus may also use supported app-open, power-on, and unlock signals, but mobile operating systems control whether and when those signals can be detected or transmitted. A paid subscription is not continuous monitoring or a guaranteed check-in service. See Section 3. - Subscription. Guardian Plus is an auto-renewing subscription billed by Apple or Google at the price shown in your store before purchase. Manage or cancel it in your App Store / Play subscription settings. Cancellation stops future renewal; paid access continues until the current billing period ends. No prorated refund or credit is provided merely for cancelling mid-period, subject to applicable law and store refund policies. - Legal stuff. The Service is provided "as is," our liability is limited, and these terms are governed by the law of Ontario, Canada. - Eligibility. You must be the age of majority (or have guardian consent) and at least 13.

1. Acceptance of these terms

1.1 These Terms of Service ("Terms") are a binding agreement between you and Extension Tech Inc. ("we", "us", "our"), the developer of the Got Your 6 mobile application (bundle identifier app.getyour6.mobile) and related services (together, the "Service").

1.2 By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

1.3 We may update these Terms from time to time (Section 16).

2. What the Service does

The Service provides personal-safety features, which may include:

  • SOS button — alerts your chosen emergency contacts with your location after a short cancel window, then continues sharing your live location until you end the session.
  • "Track me" — user-initiated, interval-based live location sharing with your contacts.
  • Dead-man's switch (inactivity check) — the Service uses an inactivity window you choose (currently 24, 48, or 72 hours) and measures whether a valid check-in reaches us in time. Free users check in manually. Guardian Plus may also treat supported app-open, power-on, and unlock signals as check-ins when the device, operating system, app, authentication, and network permit the signal to reach us. If no valid check-in reaches us before the inactivity window and grace period end, the Service attempts to alert your contacts with your last known location.
  • Watch circle — mutual, consent-based live-location sharing between users who accept each other's invitations.
  • Voice-activated SOS — optional on-device wake-word detection that can trigger an SOS. Audio is processed entirely on your device and is never recorded or transmitted.

Features may vary by platform, subscription tier, device capability, and permissions you grant.

3. SAFETY DISCLAIMER — PLEASE READ CAREFULLY

THIS SECTION IS IMPORTANT. THE SERVICE IS A SUPPLEMENTARY SAFETY TOOL, NOT A LIFELINE.

3.1 GOT YOUR 6 IS NOT AN EMERGENCY RESPONSE SERVICE AND IS NOT A SUBSTITUTE FOR 911 OR ANY PROFESSIONAL EMERGENCY, POLICE, MEDICAL, FIRE, OR RESCUE SERVICE. IT DOES NOT CONTACT PUBLIC AUTHORITIES OR DISPATCH RESPONDERS. IN AN EMERGENCY, CALL YOUR LOCAL EMERGENCY NUMBER (SUCH AS 911) DIRECTLY.

3.2 WE DO NOT AND CANNOT GUARANTEE THAT ANY ALERT, LOCATION UPDATE, OR NOTIFICATION WILL BE GENERATED, TRANSMITTED, DELIVERED, RECEIVED, OR ACTED UPON. The Service depends on factors outside our control, including but not limited to: your device's power and battery; cellular, Wi-Fi, GPS, and internet connectivity; operating-system permissions and background-execution limits; "Do Not Disturb," Focus, low-power, or battery-optimization modes; app or OS updates; and the availability and performance of third-party networks (mobile carriers, SMS gateways, email providers, and Apple/Google push services). Such circumstances include, but are not limited to, airplane mode, powered-off or disconnected devices, inactive or suspended cellular service, insufficient signal coverage, exhausted data plans, and recipients who changed numbers.

3.2.1 SATELLITE-TO-PHONE SERVICE IS LIMITED AND DOES NOT GUARANTEE CONNECTIVITY. Before entering an area without regular cellular coverage, check with your telecom provider whether satellite-to-phone service, including a service using Starlink Direct to Cell, is available in your country and area and is supported by your provider, plan, device, operating system, and enabled settings. Where appropriate, add or enable the service before travel and test it outdoors. We do not provide, resell, control, or guarantee any satellite service, and naming Starlink does not imply sponsorship, affiliation, or endorsement.

  • SMS and messaging. Satellite messages may take longer to send or arrive because of satellite availability, routing, network capacity, and retransmission. Supported features vary. SMS text may work while MMS, RCS, group chats, pictures, videos, audio, links, or other attachments are delayed, degraded, limited, or unavailable.
  • Push notifications. Push notifications require a supported data connection to Apple, Google, our servers, and other notification providers. Satellite data may be slow, constrained, prioritized, throttled, interrupted, or unsupported for this app. Alerts may therefore wake the app late, arrive out of order or more than once, remain pending, or never arrive, and the app may disconnect from notification services.
  • Sky view and intermittent service. Satellite-to-phone service generally requires a compatible device in a supported outdoor coverage area with a sufficiently clear view of the sky. Hills, mountains, valleys, dense trees, buildings, roofs, vehicles, terrain, weather, satellite position, congestion, movement, and other obstructions or conditions can delay, interrupt, or block service.
  • Geolocation. Satellite connectivity does not guarantee that the device can determine or preserve an accurate location. GPS/GNSS and other location estimates may be delayed, unavailable, stale, imprecise, or incorrect because of sky obstruction, terrain, weather, device state, permissions, sensor limitations, or operating-system restrictions.
  • Location sharing. Determining a position and sharing it are separate operations. Even if the device obtains a location, Got Your 6 must run and transmit that location to our servers, and a recipient must retrieve it. A slow, constrained, unsupported, or interrupted satellite data link can delay or prevent uploads, live updates, map refreshes, SOS or Track Me sharing, Circle sharing, and delivery of a last known location. Recipients may see no position or an incomplete, stale, or inaccurate position.

Satellite service may improve the chance of connectivity in some remote areas, but it is a supplementary backup and must not be treated as continuous coverage, proof that an alert or location was delivered, or a substitute for an independent emergency plan or professional emergency services.

3.3 YOUR EMERGENCY CONTACTS ARE PEOPLE, NOT PROFESSIONALS. They may not see, read, understand, or act on an alert. They may be unavailable, unreachable, or unwilling or unable to help. We are not responsible for their acts or omissions.

3.4 VOICE-ACTIVATED SOS MAY NOT DETECT YOUR PHRASE, may produce false triggers, and depends on microphone availability and device state. It is a convenience feature, not a guaranteed trigger.

3.5 YOU ARE RESPONSIBLE FOR YOUR OWN SAFETY. Do not rely on the Service as your sole means of obtaining help, and do not place yourself in danger in reliance on it. Test the Service and understand its limits before you need it.

3.6 LOCATION AND STATUS INFORMATION MAY BE DELAYED, INCOMPLETE, STALE, OR INACCURATE. GPS, device sensors, timestamps, geocoding, background execution, network transit, and cached data can all introduce errors. A map marker, delivery status, health indicator, or incident status must not be treated as confirmation of a person's condition, exact location, message receipt, or provider availability.

3.7 MONITORING IS NOT A GUARANTEE. We may use automated health checks, error monitoring (including Sentry), delivery receipts, provider callbacks, alerts, and staff incident tools. These controls can themselves fail, be delayed, produce false positives or false negatives, or be unavailable during the same incident they are intended to detect. Their presence does not create a guarantee, service level, fiduciary duty, or duty to monitor continuously.

### Inactivity-check and automatic-activity limitations

3.8 FREE CHECK-INS ARE MANUAL; GUARDIAN PLUS AUTOMATION IS BEST-EFFORT. On the free tier, only an explicit manual check-in resets the inactivity timer. Guardian Plus may additionally treat a supported app open or foreground event, detected device power-on, or detected unlock as a check-in. These automatic events are convenience signals, are not continuously monitored, and are not guaranteed to be detected, generated, transmitted, received, processed, or processed before a deadline. Paying for Guardian Plus does not create an emergency-response, continuous-monitoring, guaranteed-heartbeat, or guaranteed-check-in service.

3.9 MOBILE OPERATING SYSTEMS CONTROL BACKGROUND EXECUTION. Apple, Google, device manufacturers, and mobile carriers control whether and when the app may run while backgrounded, suspended, locked, or not running. Scheduled background work may run late or not at all. Silent push notifications may be delayed, throttled, replaced, discarded, or undelivered. A terminated or force-quit app may not be relaunched. Some platforms do not provide a supported way to detect every unlock or to launch the app immediately when a device powers on, so a power-on or unlock may be recorded only during a later permitted execution opportunity or may never be recorded.

3.10 A DEVICE HEARTBEAT IS NOT PROOF OF USER SAFETY. A background heartbeat, push acknowledgement, provider receipt, network response, or other device-reachability signal may indicate only that a device or app installation was reachable. It does not prove that the account holder used the device, is safe, saw a prompt, or personally responded. Conversely, failure to receive a heartbeat does not prove that a device is powered off or that the account holder needs help. Device-reachability signals do not reset the inactivity timer unless the Service classifies the signal as a valid check-in for the applicable subscription tier.

3.11 DEVICE AND ACCOUNT CONDITIONS CAN PREVENT AUTOMATION. Automatic check-ins and prompts may not work if, for example, you force-quit, sign out of, uninstall, fail to update, or do not open the app; disable Background App Refresh, notifications, mobile data, permissions, or other required settings; use airplane, Focus, low-power, or battery-optimization modes; lose network service; allow the battery to discharge; change devices or accounts; or if authentication credentials, push tokens, operating-system registrations, or background schedules expire, are revoked, or become unavailable. You are responsible for keeping your device charged and connected, remaining signed in, maintaining required settings and permissions, keeping contact information current, and checking the app's displayed status. Even when you do so, operation is not guaranteed.

3.12 TIMING CAN PRODUCE MISSED OR FALSE ALERTS. An activity event may reach us after the inactivity deadline or grace period, and an alert may be attempted despite recent device or user activity that was not reported in time. A check-in, prompt, or alert may also be duplicated, delayed, incomplete, misclassified, or omitted because of software, scheduling, clock, queue, provider, device, authentication, or network conditions. A reminder scheduled locally on your device may be late, stale, or absent. Opening a reminder is not a confirmed check-in: the Service must receive and confirm an authenticated "I'm OK" action or other valid check-in. If you respond while offline, the app may retain and retry the response, but the server timer continues and contacts may still be alerted until the server confirms it. Continue to check in manually, do not rely on automatic activity detection as your sole safety measure, and contact emergency services directly when help is needed.

4. Eligibility

4.1 You must be at least the age of majority in your jurisdiction to enter into these Terms. If you are a minor above 13 but below the age of majority, you may use the Service only with the involvement, consent, and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

4.2 The Service is not directed to children under 13, and they may not use it.

4.3 You must be legally permitted to use the Service in your jurisdiction.

5. Your account and OTP security

5.1 You sign in using your phone number and a one-time passcode (OTP). You are responsible for maintaining access to your phone number and for all activity that occurs under your account.

5.2 Keep your device and OTP secure. Do not share your OTP. If you believe your account or device has been compromised, secure your device and contact us at support@gotyour6.app.

5.3 You agree to provide accurate account information (including your name and, if provided, email) and to keep it current.

5.4 If you change or relinquish your phone number, you are responsible for updating or closing your account so that alerts and account access are not misdirected.

6. Acceptable use

You agree not to:

  • Send false, fake, or malicious SOS alerts or otherwise misuse the Service in a way that could waste others' time, cause alarm, or endanger anyone.
  • Use the Service to harass, stalk, surveil, or track any person without their knowledge and consent, or in any way that violates another person's rights.
  • Add emergency contacts without their permission, or add contact details you are not authorized to provide.
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service, our servers, or third-party networks.
  • Reverse engineer, decompile, or attempt to extract source code except to the extent this restriction is prohibited by law.
  • Resell, sublicense, or commercially exploit the Service without our written permission.

We may suspend or terminate accounts that violate this Section (see Section 15).

7. Emergency contacts — your responsibilities

7.1 Accuracy. You are solely responsible for entering and maintaining accurate emergency-contact details. Incorrect details (wrong number or email) can cause alerts to fail or to reach the wrong person.

7.2 Permission to add a contact is separate from SMS consent. You must have permission to provide another person's details and share your safety information with them. Adding a contact, enabling an SMS preference, accepting a watch-circle invitation, or your assertion of permission does not enroll that person in SMS. Each recipient must personally opt in for each emergency-contact relationship using the process below. Existing contacts without a recorded opt-in do not receive emergency-contact SMS.

7.3 Got Your 6 safety SMS program. Extension Tech Inc. sends non-marketing, automated safety texts, including SOS and inactivity alerts, Track Me sharing links, and related emergency-contact updates. Message frequency varies with the account owner's activity. Message and data rates may apply. SMS consent is optional and is not a condition of purchase. Consent does not guarantee message delivery, monitoring, or emergency response; Section 3 applies.

  • Opt in. The account owner shares a secure invitation link through a channel they choose outside our automated SMS service. The link expires after seven days. The recipient reviews the identified account owner, program disclosures, SMS Terms and SMS Privacy Policy, then sends the displayed JOIN command and invitation code to the displayed Got Your 6 number from the phone number named in the invitation. Opening the link or the SMS composer alone does not grant consent. We record a successful opt-in and send a confirmation. Do not forward an invitation to someone else or send the command on their behalf.
  • Opt out. Reply STOP to the Got Your 6 number to stop Got Your 6 safety SMS to that phone number across emergency-contact relationships. We may send one opt-out confirmation. A contact does not need the account owner's permission to stop SMS. STOP can also block requested sign-in codes sent to that number until unblocked. STOP does not itself remove a contact, end Circle sharing, or disable email or push notifications. Contact support if you need help ending those relationships or other notifications.
  • Help and resubscription. Reply HELP for assistance or email support@gotyour6.app. After STOP, a carrier/provider may require START before it permits messages again. START alone does not renew consent in our app; ask the owner for a fresh invitation and complete the opt-in again.
  • Contact changes. The owner can remove a contact at any time. Adding or removing contacts may produce email or in-app notifications; SMS is attempted only when the recipient has valid consent and has not opted out. If someone asks not to be contacted, remove them promptly. Changing a contact's phone number requires fresh SMS consent for the new number.

7.4 Watch circle. Watch-circle sharing is mutual and consent-based; a person must accept your invitation before receiving Circle location. Either party may exit the circle at any time, after which both parties are notified and mutual circle-location sharing ends. Circle acceptance is not SMS consent. Exiting the circle does not remove the separate emergency-contact relationship or change its SMS consent; STOP remains available independently. 7.5 Activity history. The Service may retain and display an account activity history recording emergency-contact additions and removals, watch-circle joins and exits, and safety incidents. For an event involving two app users, each user's history may describe the other person's role in that event. Activity history is informational, may be delayed or unavailable, and is not a guaranteed audit record or substitute for directly confirming the current contact and circle lists.

7.6 You agree to indemnify us for claims arising from contact details you provide or from your failure to obtain necessary consent (Section 14).

8. Subscriptions, billing, and refunds

8.1 Free tier and Guardian Plus. The Service offers a free tier and an optional "Guardian Plus" auto-renewing subscription at the price shown in your store before purchase, which may vary by region and is subject to change with notice as permitted by the stores.

8.1.1 Circle messages. Guardian Plus includes ten Circle marker messages per subscription billing cycle. An optional "Unlimited Circle Messages" auto-renewing add-on is available only while Guardian Plus is active at the price shown by the App Store before purchase. Messages accepted by the Service count toward the allowance even if a device or push provider later delays or fails delivery.

The add-on is a separate App Store subscription. Expiry or revocation of Guardian Plus disables use of the add-on but does not automatically cancel its App Store billing; you must manage each subscription from your App Store account.

8.1.2 Track Me SMS allowance. The Free tier includes up to 10 provider-accepted Track Me SMS deliveries per UTC calendar month, and Guardian Plus includes up to 100. Each recipient SMS counts separately. If the remaining allowance cannot cover every SMS-enabled contact, no Track Me SMS is sent; eligible push and email notifications may still be sent and Track Me location sharing may still operate. Provider-accepted retries count again. SOS messages are not deducted from this allowance.

An optional "Unlimited Track Me SMS" auto-renewing add-on is available while Guardian Plus is active at the price shown by the App Store before purchase. While active, it removes the monthly Track Me SMS delivery cap. It does not remove phone-verification requirements, restart cooldowns, recipient preferences, or provider and network limitations, and does not guarantee delivery. It is separate from Unlimited Circle Messages. Cancelling this add-on leaves access until the paid period ends unless it is refunded or revoked. Expiry or revocation of Guardian Plus disables use of this add-on but does not automatically cancel its separate store billing; manage each subscription in your store account.

To reduce duplicate messages, restarting Track Me within 30 minutes may reactivate the existing private link without sending another start SMS. We may require phone reverification after five new SOS incidents are created within 24 hours, but this safeguard does not disable or delay SOS.

8.2 Billing is handled by the app stores. Guardian Plus is sold and billed exclusively through Apple In-App Purchase on iOS and Google Play Billing on Android. Apple or Google processes your payment. We never receive or store your payment-card details.

8.3 Auto-renewal. Subscriptions renew automatically for successive one-month periods at the then-current price unless you cancel at least 24 hours before the end of the current period. Your store account is charged for renewal within 24 hours prior to the end of the current period.

8.4 Managing and cancelling. You manage and cancel your subscription in your App Store or Google Play account subscription settings. Cancelling turns off future automatic renewal; it does not immediately end the current paid subscription. You retain paid access until the expiry date shown by your store, unless the purchase is refunded or revoked, or access ends under Section 15. This applies to Guardian Plus and paid add-ons, subject to any requirement for an active Guardian Plus subscription. A monthly billing period follows the dates shown by your store and is not necessarily exactly 30 days. Uninstalling the app or deleting your account does not cancel store billing.

8.4.1 Actual access period. Your paid access period is determined by the start and expiry dates recorded by the store, rather than a fixed number of days calculated by us. A monthly subscription is not necessarily a 30-day subscription: months may have 28, 29, 30 or 31 days, and the store determines the applicable renewal and expiry dates. A verified renewal updates the paid access end date. Turning off automatic renewal does not shorten the current paid period.

8.4.2 Expiry and remaining access shown in the app. When verified subscription information is available, the app displays the paid access end date and time in your device's local time. It shows "Renews" when automatic renewal is confirmed as enabled and "Access ends" otherwise; "Access ends" alone does not confirm that renewal has been cancelled. Remaining access days are complete 24-hour periods until that expiry time, rounded down. If some access remains but less than 24 hours, the app shows "Less than 1 day of access remaining". This display does not shorten or extend your paid access.

8.4.3 Offline or unavailable subscription information. While offline, the app may display the last verified access date, identified as such. Recent renewals, cancellations or refunds may not appear until the app reconnects and refreshes. If a verified expiry is unavailable, the app does not substitute an assumed 30-day period. Check your store subscription settings for the current billing and subscription status, and contact support@gotyour6.app if the app and store disagree. A cached date or remaining-days display does not create additional paid access or a refund entitlement.

8.5 Refunds and unused time. Cancelling during a paid billing period does not, by itself, entitle you to a full or prorated refund or credit for the remaining days or for unused features. Except where required by applicable law or provided under Apple’s or Google Play’s refund policies, subscription fees already paid are non-refundable. Purchases are handled by Apple or Google, and refund requests should be submitted through the store where you purchased the subscription. Apple or Google may approve a refund under its policies; these Terms do not restrict that authority or any non-waivable consumer rights. If a purchase is refunded or revoked, the associated paid access may end before the original expiry date. We do not separately issue refunds for store-billed purchases except where required by law.

8.5.1 Annual-plan refunds. If an annual plan is offered and you cancel during the paid year, you may request a refund for unused subscription time through the store where you purchased it, or contact support@gotyour6.app for assistance. Any refund is subject to the applicable store policies and refund process. The amount payable to you is the final refund amount approved and processed through the Apple App Store or Google Play, subject to applicable law. We do not guarantee a particular amount or a refund calculated as the annual price divided by 12 for each unused month. Cancellation alone does not initiate or guarantee a refund. If a refund is approved, paid access may end before the original annual expiry date in accordance with the store's handling of that refund. Nothing in this provision limits your non-waivable consumer rights.

8.6 Feature changes. Which features are included in the free tier versus Guardian Plus may change over time. We will not materially reduce features you have paid for during a paid period without a lawful basis.

9. Third-party services and stores

9.1 The Service relies on third parties, including Apple and Google (distribution, operating-system services, push, and billing), mobile carriers, mapping/location services, hosting and database infrastructure, SMS and email providers, error-monitoring providers (including Sentry), internet and DNS providers, and other subprocessors described in the Privacy Policy.

9.2 We do not own or control those services. They may change, restrict, suspend, discontinue, delay, reject, rate-limit, misroute, or lose data or messages; experience outages or security incidents; or impose technical and contractual limits. Their status pages, receipts, callbacks, acknowledgements, and success responses are not guarantees of end-user receipt or successful operation.

9.3 Your use of the app stores is subject to their terms. These Terms are between you and us, not with Apple or Google. Where the Apple-required "Licensed Application End User License Agreement" terms apply, Apple is not responsible for the Service or for addressing any claims relating to it, and Apple and Google are third-party beneficiaries entitled to enforce these Terms against you to the extent applicable.

9.4 To the maximum extent permitted by law and subject to Section 12, we are not responsible for interruption or failure caused by a third-party service outside our reasonable control. This does not limit obligations or liability that cannot lawfully be excluded, including any obligation to select and oversee processors with reasonable care or to comply with applicable privacy and consumer-protection law.

10. Intellectual property

10.1 The Service, including its software, design, logos, and content (excluding your data and content), is owned by Extension Tech Inc. or its licensors and is protected by intellectual-property laws.

10.2 Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Service on devices you own or control, for your personal, non-commercial use.

10.3 You retain rights in the information you provide (such as your profile and contact list). You grant us the limited rights necessary to operate the Service and deliver alerts as you direct (see the Privacy Policy).

11. Disclaimer of warranties

11.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

11.2 WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR THAT ANY ALERT OR LOCATION UPDATE WILL BE DELIVERED OR ACTED UPON (see Section 3).

11.3 We do not warrant that monitoring, incident detection, provider receipts, backups, redundancy, failover, restoration, or support will identify every fault, prevent loss, restore all data, or return the Service to operation within any particular time. Unless we expressly agree otherwise in writing, the Service has no guaranteed uptime, response-time, recovery-time, or recovery-point service level.

11.4 Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, some of the above exclusions may not apply to you, and you may have additional rights. Nothing in these Terms limits any non-excludable statutory or consumer-protection rights you have under the laws of your jurisdiction (including, where applicable, Ontario consumer-protection law).

12. Limitation of liability

12.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, Extension Tech Inc. AND ITS DEVELOPER, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR — TO THE EXTENT PERMITTED BY LAW — FOR PERSONAL INJURY, EMOTIONAL DISTRESS, OR DEATH, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, OR ANY FAILURE OF AN ALERT OR LOCATION UPDATE TO BE GENERATED, DELIVERED, RECEIVED, OR ACTED UPON. This includes claims relating to software defects, inaccurate or stale data, configuration errors, maintenance, capacity limits, device or network failure, third-party-provider acts or outages, malicious attacks, data corruption or loss, unsuccessful backup or restoration, and force-majeure events described in Section 13, whether based in contract, tort (including negligence), strict liability, or any other theory, even if we have been advised of the possibility of such damages.

12.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid us (through the app stores) for the Service in the twelve (12) months before the event giving rise to the claim, or (b) CAD $50.

12.3 Some jurisdictions do not allow the exclusion or limitation of certain damages (including incidental or consequential damages, or limitations on liability for personal injury or death caused by negligence). In those jurisdictions, our liability is limited to the smallest extent permitted by law, and the limitations in this Section apply only to the extent allowed. Nothing in these Terms excludes liability that cannot lawfully be excluded.

12.4 The allocation of risk in Sections 3, 11, and 12 is a fundamental basis of the bargain between you and us and reflects the price of the Service.

13. Beta features, maintenance, outages, recovery, and force majeure

13.1 Beta and feature changes. The Service may include features that are new, experimental, or not fully validated across all devices and operating systems. We may add, change, suspend, or discontinue features and may set reasonable limits (for example, on the number of contacts on the free tier), subject to applicable law and any paid-period commitment in Section 8.6.

13.2 Maintenance and availability. We may perform planned or emergency maintenance, deploy security fixes, restrict traffic, disable integrations, or temporarily suspend all or part of the Service when reasonably necessary to protect users, data, providers, or the Service. Maintenance or remediation may occur without advance notice where notice is impracticable or would increase risk. We do not promise uninterrupted availability or any particular maintenance window.

13.3 Incident detection and communications. We may investigate incidents and provide status or recovery information using reasonable available channels. Initial assessments can be incomplete or change as facts develop. Any estimate, status indicator, incident classification, delivery receipt, or expected recovery time is informational only and is not a warranty. We do not promise that every incident will be detected, publicly disclosed, or individually communicated unless applicable law requires it.

13.4 Data integrity and recovery. We may use backups, replication, queues, retries, and restoration procedures, but no control eliminates all risk. Data may be delayed, duplicated, corrupted, or permanently lost, and restoration may be incomplete. Do not use the Service as the sole record of information you must retain and do not assume that retry or recovery will occur before help is needed.

13.5 Force majeure. To the maximum extent permitted by law, neither party is liable for delay or failure to perform caused by circumstances beyond its reasonable control, including natural disasters, severe weather, fire, flood, epidemic or pandemic, war, terrorism, civil disorder, governmental or regulatory action, labour disruption, utility or power failure, internet or telecommunications failure, carrier or cloud-platform outage, failure of a critical third-party provider, or a cyberattack that was not caused by a failure to use reasonable safeguards. This clause does not excuse payment obligations already due, obligations that can reasonably continue despite the event, or any privacy, security, breach-notification, consumer-protection, or other obligation that cannot lawfully be limited.

13.6 Mitigation. A party relying on Section 13.5 must use commercially reasonable efforts to reduce the impact and resume affected performance when reasonably possible. Nothing in this Section creates a guaranteed recovery time or requires unsafe restoration of a compromised system.

14. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Extension Tech Inc. and its developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms or any law; (c) emergency-contact details you provide or your failure to obtain a contact's consent; or (d) your infringement of any third-party right.

15. Termination

15.1 By you. You may stop using the Service and delete your account at any time (see the Privacy Policy for deletion). Deleting your account does not by itself cancel a store subscription — cancel that in your App Store / Play settings (Section 8).

15.2 By us. We may suspend or terminate your access, with or without notice, if you violate these Terms, misuse the Service, or where we reasonably believe it is necessary to protect users, the public, or the Service, or to comply with law.

15.3 Effect. On termination, your license ends and safety features stop working. Sections that by their nature should survive (including Sections 3, 7.5, 10, 11, 12, 13, 14, 16, and 17) survive termination.

16. Changes to these Terms

We may modify these Terms from time to time. If we make material changes, we will update the effective date above and provide notice by reasonable means (such as in the app). Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree to the changes, stop using the Service.
